Terms

GENERAL

The following terms and conditions apply to all orders placed by you, “the customer”, on the website:

By placing an order, you agree to be bound by the Terms and Conditions set out herein. Please make sure you have read and understood them before placing your order.
Only persons 18 years or older, who are not under guardianship, and are not acting in the capacity of a company can place an order.
We reserve the right to amend these Terms and Conditions from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on site at the time you place your order.
In the event any section or portion of a section of these Terms of Sale are deemed unlawful or unenforceable, that section or portion of a section shall be stricken from the Terms of Sale, and the remaining terms shall continue in full force and effect.
WickedMX shall not be responsible for damages or delays resulting from ‘force majeure’, and from other actions, both governmental and otherwise, including but not limited to war, riot, seizure, and embargo.

2. PRODUCTS

All graphics are custom designed by wickedmx and have no representation of the original manufactures design.

The inclusion of any products or services on wickedmx at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see on wickedmx will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.

3. PRICES AND DELIVERY CHARGES

The prices displayed include the statutory Value Added Tax (VAT), please see Shipping Policy for more shipping information.

3.1 PRICES

Prices and promotions listed on wickedmx and are subject to change without notice.

3.2 DELIVERY CHARGES

All orders may be subject to a delivery charge. The delivery charge will be added in the checkout, see Shipping Policy for more information

There is always a delivery charge for bulky or heavy items.

If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries.

ORDERING CONTRACT

Once you have placed your order, you will receive an email confirmation. If for any reason we are unable to fulfil your order, we will let you know at the earliest opportunity. If we have already received payment for such an order, we will attempt to refund the applicable amount using the same method used to make the payment. If for any reason, alternative arrangements are necessary, we will contact you to settle the refund.

All purchases from this website are made pursuant to a shipment contract. The order will be shipped to the address entered when placing the order.

If an error is made and a product is listed at an incorrect price, wickedmx shall maintain the right to refuse or cancel any orders placed at the incorrect price. If the order has been confirmed and charged to your credit card, wickedmx shall immediately issue a credit in the amount of the incorrect price.

5. PAYMENT METHODS & INFORMATION

Please be sure to provide the exact billing address and telephone number that your credit card has on file for you – this will ensure no delays in processing your order.

During the checkout process, you will be asked to enter your payment details. Where you are using either Shop Pay (all Debit or credit cards), Apple Pay, Google Pay, and Amazon Pay, by completing your payment details, you confirm that the payment method being used is yours. All fields indicated as compulsory must be completed. Please note that we may collect and store your information, using an encrypted secure payment mechanism and will only use your information in accordance with our Privacy and Cookie Policy.

Please be advised that where you select either Klarna or PayPal as a payment method, we will pass certain information to the relevant party (name, address, delivery address, email address, and phone number) so that they can process your application (in the case of Klarna) and provide the service. Once this information has been passed to the relevant party, wickedmx shall remain a data controller and that party shall also be a data controller in relation to that data

All card payments are subject to authorisation by your card issuer. We take full payment immediately for all products.

All products ordered will remain the property of wicked until we have delivered the products to the address specified by you or they have been collected in store. If your payment (whether the full amount or the first or subsequent instalments is not received and you have already received the products you ordered from us, you must pay for (in full) or return those products to us in accordance with our Terms and Conditions “Returns and in the same condition that you received them at your own expense. If you do not do this within 14 days of the date on which we cancel your order, we may collect or arrange for the collection of the products at your expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.

Other Payment Methods

For security reasons, we do not accept COD (cash on delivery), company cheque, personal cheque, Postal Orders, or any other method not listed here.

6. DELIVERY

wickedmx exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order to the address requested by you in your order.

Once you have placed your order, you will receive an email confirmation with your expected delivery details for the whole order.

When we communicate delivery days, we mean working days excluding weekends and public holidays.

Wickedmx endeavours to dispatch orders in the fastest possible time. Though we aim to deliver within the communicated time frame, the delivery may take longer due to unexpected events.

We cannot guarantee any firm delivery dates.

All packages are insured for damage and/or loss. The customer is (if requested) responsible for filing any claims with carriers for damaged and/or lost shipments.

7. INCORRECT ORDER

If you order an incorrect item, i.e. wrong model, and the order has gone to print, we will not be able to change your order as all orders are custom made to your own personal specification. However, we will endeavour to work with you to rectify your mistake, prior to sending the goods, please note that there will be an additional fee for the reprint of these goods, plus the delivery date of the dispatch will change due to this error.

If your order arrives damaged or incomplete or with errors, we must be notified within 7 days of receipt of these goods to [email protected] Any order must be returned complete in the original packaging, along with confirmation of the issue raised.

Credit card refunds are credited back to the card used for the original purchase. PayPal refunds will be issued to the original PayPal account

Please return all items via ground shipping within Europe otherwise standard airmail for outside Europe as directed in communications. Please note: We will not refund charges from couriers: for example Parcel Force, DPD. Royal Mail.

8. RETURNS

wickedmx guarantees a refund of returned items in accordance with our Refund Policy which you can read here.

9. EXCHANGES

We offer free size, model, and colour exchanges. For new product exchanges, prices are subject to the website price when the return is handled and not when the item is returned.

These items are excluded from the right to exchange the order:

10. WARRANTIES AND CLAIMS

Wickedmx will repair, replace, reduce the price or give you a refund if the goods you bought are faulty or defective. The same goes for products damaged during transportation.

You must report claims via e-mail promptly when discovering the fault.

Wickedmx makes no additional or independent warranty.

Wickedmx shall under no circumstances be liable for special, incidental, or consequential damages including loss of profit, even if it has been advised of the possibility of such damages. The maximum liability for all direct damages, if any, arising out of any action shall be limited to an amount not to exceed the purchase price of the product.

11. OUR RESPONSIBILITY

Nothing in these Terms shall exclude or limit Wickedmx liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.
Wickedmx is not responsible for indirect losses which are a side effect of the main loss or damage, for example, loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, and terrorist activity.

Our maximum liability to you for any loss or damage arising in connection with your order on Wickedmx shall be limited to the total price of your order.
